Kristen Milanos family is suing the town of Southington Fire Department for negligence and failure to perform to reasonable expectations.
The allegations are according to the intent to sue notice, filed Tuesday at Town hall.
Kristen Milano, 19, died in an apartment fire on Darling Street on June 22.
Eric Morelli, 18, is charged with manslaughter in the case.
Friends and fellow tenants say Morelli threw a lit firecracker into the Milano apartment — and that started the fire, but under a judge’s order, police documents related to Morelli’s involvement will remain sealed– and that decision is causing a roadblock for the attorneys trying to pursue their civil case.
At least officially, little is known about what happened in the early morning fire, but the lawsuit claims that firefighters failed to locate Kristen Milano, who was asleep in her mother’s bedroom, and firefighters’ inadequate response has caused the family pain and suffering.
