HARTFORD — A federal judge has granted the city of Hartford’s motion to dismiss a constitutional case, saying the “Scarborough 11” did not exhaust all city options to resolve a zoning dispute before resorting to a federal challenge.
Officials said eight adults and three children were violating zoning laws limiting the number of unrelated residents to two people for single-family homes.
The city sued demanding an end to the living arrangement.
The Hartford Courant reports that a judge gave the group 21 days to file an amended complaint proving the Zoning Board of Appeals would have denied a variance had they had sought one. The judge may reopen the case if convinced.
The group’s attorney says they plan to file a stronger complaint.
