NEW LONDON — A Massachusetts man’s lawsuit alleging Connecticut transportation officials took too long to treat black ice that caused him to crash his truck on the Gold Star Memorial Bridge will go forward.

Barry Graham had sued the state under the defective highway act over the December 2011 crash that left him injured. A New London judge last year granted the state’s motion for summary judgment after finding the state Department of Transportation’s response time was reasonable.

The Day reported on Monday that the state Appellate Court ruled that the question of whether the DOT responded reasonably to the reported highway defect should be determined at a trial.

An attorney representing the DOT didn’t immediately respond to a request for comment.
