BRIDGEPORT — A Superior Court judge has refused to dismiss charges facing a former Connecticut high school teacher who is accused of having sex with one of his female students.

Glenn Mishuck’s lawyer, William Westcott, argued Thursday that sexual assault case should be tossed out because the relationship occurred over the summer, when school was out of session.

Superior Court Judge Maria Kahn ruled the law is intended to protect students for more than 10 months out of the year.

Mishuck was a teacher at Fairfield Ludlowe High School.

He was arrested in October, 2013 after the 17-year-old girl’s father gave police text messages he found between the 47-year-old and his daughter.

Prosecutors say they will also present evidence of a second sexual relationship Mishuck had while teaching in Stamford.
