I was at a stop sign, when I was rear-ended by an out of state driver who was trying to take a picture of the fall foliage with his cell phone.Not only is my car demolished, but I am also out of work due to severe neck pain.
My question is, can I bring a claim against an out of state driver and does the fact that he was driving while distracted affect my case?
