Carminuccio’s Pizza in Newtown must improve ADA accessibility

The U.S. Attorney’s Office has reached a settlement with the restaurant to address allegations of non-compliance with the Americans with Disabilities Act.

Carminuccio's Pizza has settled with the U.S. Attorney's Office to improve its accessibility, as is mandated by the ADA.

NEWTOWN, Conn. — A Newtown pizza parlor has settled with the Office of the U.S. Attorney for the District of Connecticut to address allegations of noncompliance with the Americans with Disabilities Act.

A release from the U.S. Attorney notes that a settlement has been reached with Carminuccio’s Pizza, a restaurant located on South main Street in Newtown.

A complaint was filed with the U.S. Department of Justice alleging that Carminuccio’s Pizza was not accessible to individuals with mobility disabilities. The settlement agreement will resolve the complaint.

The ADA mandates that public accommodations such as restaurants cannot discriminate against people with disabilities. Physical barriers must be removed from public accommodations to allow individuals with mobility disabilities to access those spaces. Renovations undertaken after the effective date of the ADA must create spaces that are readily accessible to and usable by individuals with disabilities to the maximum extent possible.

The settlement agreement requires Carminuccio’s Pizza to make its parking area more accessible and add a ramp to the entrance of the restaurant. The restaurant must also add accessible dining tables and make several more changes to make the bathroom more accessible.

Carminuccio’s Pizza has reportedly agreed to comply with Title III of the ADA in all future alterations and renovations.

The U.S. Attorney noted that the owner and operator of Carminuccio’s Pizza has worked cooperatively with her office to improve their ADA compliance without going to court. The settlement agreement is effective for three years, during which time the U.S. Attorney’s Office will monitor compliance.
