NEW HAVEN — One of two men who killed a woman and her two daughters in a 2007 home invasion in Cheshire has dropped his appeal of his conviction.

Steven Hayes had been on Connecticut’s death row but he was spared execution last year when a state court outlawed capital punishment.

The Hartford Courant reports that his lawyer withdrew the appeal on Wednesday. A hearing on the appeal had been scheduled for July 13 before the state Supreme Court.

Hayes and an accomplice, Joshua Komisarjevsky, were convicted in the slayings of Jennifer Hawke-Petit and her two daughters after a night of torment inside the family’s suburban home.

Komisarjevsky’s appeal of his conviction is still pending.
