TROCONIS TRIAL: Still no resolution in contempt of court charge; attorneys working toward disposition

Troconis pleaded not guilty to the charge back in July.

STAMFORD, Conn. — The court did not come to a resolution Monday on the contempt of court charge filed against Michelle Troconis. This comes as her public defender is working on her release as he appeals her conspiracy to commit murder conviction from earlier this year.

“Your honor this morning, counsel and I spoke with Judge Hernandez. Essentially had a pretrial, your honor, no offer was conveyed on the matter. But we did have further discussions on the case,” said Assistant State's Attorney, Elizabeth Moran.

Attorney Moran, Troconis, and her attorney, Robert Frost talked about the matter in a Stamford court on Monday. The parties involved agreed to reassess in court on November 13th.

“That will be working toward a disposition in this case. And if not, we’ll be able to schedule it either for a hearing or for a trial possibly at that point,” Moran said.

The newest charge follows a conviction from earlier this year, where Troconis was found guilty on separate charges and sentenced to 14 and a half years in prison for her role in the death of Jennifer Farber Dulos.

The contempt charge came during the trial, when prosecutors allege Troconis displayed sealed court documents on her computer involving the contentious divorce between Jennifer, and her estranged husband, Fotis Dulos. Court paperwork said that video was livestreamed for the public, and members of the court gallery, to see.

Frost recently asked for permission to allow the videographer who caught the moment on camera to testify, and for clarification on the charge. Those matters may be addressed at Troconis’ next court date on Nov. 13th.

In the meantime, Troconis’ public defender, Michael Brown, filed new paperwork related to her conviction.

“My daughter remains strong and confident that the new pending cases are going to reveal the truth,” said Marisela Arreaza outside of court Monday.

Brown filed a Habeas corpus petition, asking for his client to be released from prison during the appeals process.  In the document, he argues that his client’s constitutional right of effective counsel was violated by her original attorney, who Brown claims failed her.

The document also argues his client’s right to due process was violated by prosecutors by not keeping the agreement Brown claims was in place for Troconis’ cooperation in the case against Fotis Dulos. It states Troconis thought she was a witness in that case and should have been given the same immunity as others who spoke with police.

FOX61 reached out to Troconis' original attorney Andrew Bowman, who said while he can't comment on specifics due to attorney-client privilege, he absolutely refutes the claims made in the petition.

FOX61 also reached out to the former prosecutor listed in the document and is waiting to hear back.
