Brooklyn 'deadly force' shooting in May 2023 justified: Report

As the man went toward the state troopers with his knife raised, a state trooper fired one round from his handgun, which hit the man's abdomen.

The state's Inspector General has concluded that the "deadly force" a state police trooper used in a shooting that injured a Brooklyn man in May 2023 was justified.

Inspector General Robert J. Devlin, Jr. revealed his report on the deadly force shooting investigation Wednesday.

On May 9, 2023, state marshals, Connecticut State Police and Animal Control officers were called to an apartment on Tiffany Street to execute an eviction order.

The tenant, Bryon Harvey refused to leave, the report said. Harvey had his dog with him and was holding a large, military-style knife.

Troopers told Harvey to put down his knife several times, according to the report.

“I was very concerned about the possibility of an aggressive dog coming at us and having to deal with that as well as a knife attack in a small, confined space with no avenue of retreat," Trooper Romello Lumpkin recalled in the report.

Harvey then said to police, “You’re going to have to shoot me … if you don’t, I’m going to get at least one of you.”

As Harvey went toward the state troopers with his knife raised, Lumpkin fired one round from his handgun, which hit Harvey's abdomen.

"I have determined that Trooper Lumpkin used deadly force to defend himself and Sergeant Lovell from what he reasonably believed to be a threat of serious injury or death. Accordingly, I find such force to be objectively reasonable and justified," the Inspector General said.

Harvey was hospitalized and was released about a month later. He was then taken into custody and was charged with attempted assault.
